By joining online as a member of this group and/or any event hosted by this group, you hereby release its organizers, hosts, and participants from any and all liability, claims, demands or causes of action that you now have, or may have in the future, for illness, injuries, damages, all other physical, mental and emotional reactions, death and/or economic loss of any kind or nature, arising in whole or in part out of the activities, advice, or information contained herein.

The events, classes and programs listed are an opportunity for members to participate, practice, and socialize with other people. A “yes” rsvp means you understand, accept, and agree that you and your guests are solely responsible for your own choices, actions, conduct and safety in regards to all possible hazards and inherent risks, including COVID-19, associated with participating in this activity and meeting new people. 
By attending this event, you agree to not hold any organizers, hosts, or participants liable. The hosts or organizers are just present to facilitate and/or coordinate.

Serious Medical Conditions that may be affected by Breathwork or Fitness Practices:

● heart attack or serious heart problems
● serious lung problems or injury to torso
● high blood pressure
● diabetes
● glaucoma
● retinal detachment
● osteoporosis
● recent injury or surgery
● any condition for which you take regular medications
● history of panic attack, psychosis, recent trauma, or disturbances
● severe mental illness
● seizure disorders (epilepsy, etc.)
● family history of aneurysms

Strong and activating breathwork is also not recommended for pregnant women or breastfeeding women.

1 – Our services and guided meditations offered with Origins Unity are to be taken at your own risk. By joining this group, you are agreeing to take personal responsibility for any and all consequences that may unintendedly occur, despite our best wishes. Please understand that meditation, breathwork, and cold exposure have countless positive benefits for many people, however occasionally it can be problematic and should be avoided by certain individuals. Please ask your health care professional for advice and support if you are concerned in any way. We are also happy to talk and give you our feedback.

2 – We ask that you be honest with us in communicating your level of experience, particularly with cold exposure, as that poses the greatest physical risk – so we can adjust the length and intensity of the exposure to your needs.

3 – Meditation, breathwork, and cold exposure can be particularly challenging for those with a traumatic background, so please be aware that it is your responsibility whether you choose to participate or not (it can be both healthy or unhealthy, depending on how the individual works through the challenge and level of outside support they have from professionals, friends and family). Breathwork has the possibility to open up places and energetic centers in our bodies and minds that may cause seemingly uncontrollable, intense emotional, mental and physical experiences. Of course, we will do our best to support you through any obstacle that may occur.

Knowing all the above points, by joining this meetup group online or in person, you agree to take full responsibility for your actions and any consequences that may occur from practicing with or without us, and agree to not hold us liable for anything that may occur as a result from participating in Meditation, Breathwork & Cold Exposure.

DETAILED DISCLAIMER

Origins Unity, Seattle Meditation, Breathwork, Cold Exposure “SMBCE” AND Yogic Breathing Cold Plunge Seattle “YBCP” in organization with meetup.com Assumption Of Risk, Release Of Liability & Indemnification Agreement & Media Release In consideration of being permitted to participate in the Outdoor Cold water plunge and breathing (the “Activity”), and the services of Origins Unity and Seattle Meditation, Breathwork, Cold Exposure “SMBCE” its directors, employees, agents, volunteers and all other persons and entities acting in any capacity on Origins Unity and Seattle Meditation, Breathwork, Cold Exposure “OU” “SMBCE” and “YBCP” behalf in connection with the Activity (hereafter collectively referred to as “OU” and “SMBCE” and “YBCP”), I hereby understand, acknowledge and agree as follows:

Assumption of All Risks and Dangers. I understand that taking part in the Activity (including but not limited to swimming, wading, hiking, carrying and lifting equipment, and climbing on rocks and slopes) involves exposure to risks and dangers that can result in illness, physical injury and even death. Potential risks and dangers include: exposure to adverse weather conditions; equipment malfunctions and defects; collisions with man-made and natural obstacles; rugged/slippery terrain; sharp/falling rocks and timber; changing water conditions and strong river currents; physical shock or discomfort from cold water immersion; drowning; becoming lost; entrapment of body parts under rocks or other objects; poisonous plants; adverse encounters with wildlife; insect and snake bites; hypothermia; sunburn; and the negligence of other Activity participants. I understand that this description of risks and dangers is not complete, and that participating in the Activity may include other risks and dangers, including, but not limited to the acts, omissions and negligence of “SMBCE” & Associates.

RECOGNIZING THE NATURE OF THE ACTIVITY, AS WELL AS ITS RISKS AND DANGERS, I EXPRESSLY ASSUME ALL RISKS AND LIABILITIES ASSOCIATED WITH OR RESULTING FROM MY PARTICIPATION IN THE ACTIVITY.

In addition, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending the Activity. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of OU, SMBCE, YBCP & Associates, whether a COVID-19 infection occurs before, during or after attendance at the Activity.

Release of All Liability and Indemnification. I unconditionally release, to the fullest extent permitted by law, OU, SMBCE, YBCP, & Associates from any claims or causes of action for any liability or loss of any nature, including personal injury, death, and property damage, arising out of or related to my participation in the Activity, including, but not limited to claims of negligence, breach of warranty, and/or breach of contract. I agree to indemnify, defend, and hold harmless OU, SMBCE, YBCP & Associates from and against any liability or damages of any kind, and from any suits, claims or demands, including legal fees and expenses whether or not in litigation, arising out of or related to my participation in the Activity.

Media Release. I hereby grant OU and SMBCE an irrevocable, perpetual, transferable, fully paid-up/royalty-free right and license throughout the universe to record (by photographs, video and any other method or device) my attendance (including my name, title and business affiliation (as applicable), voice, image and likeness) at the Activity (the “Recordings”), and to use, modify, copy, publish, distribute and otherwise exploit such Recordings (without any need to obtain my prior approval or review) in any and all media, formats and methods of publication and transmission now known or hereafter developed for any purpose benefiting SMBCE, YBCP and/or any of its conservation or education projects and programs.

Entire Agreement; Severability. This agreement represents the entire understanding between OU, SMBCE, YBCP & Associates and me regarding its subject matter and supersedes any other statements, agreements or representations, whether written or oral, regarding the same subject matter. If any portion of this agreement is determined to be unenforceable by a court of law, the remainder of this agreement shall be enforced without regard to such provision.

I have carefully read this agreement, and understand what it means. By my signature below, I intend this agreement to be legally binding upon me, my assignees, heirs, subrogors, executors and personal representatives.

Parent or Legal Guardian Must Complete for Participants Under 18 Years of Age

I represent that I am the parent or legal guardian of each of the minor children listed below and that I have: (i) the legal authority to assume all of the risks and liabilities and to make all of the waivers and releases from liability specified above on their behalf, and (ii) the legal authority to grant OU, SMBCE and YBCP all of the rights and licenses specified above on their behalf, and I hereby do so in consideration of their being permitted to participate in the Activity. I further agree to indemnify, defend and hold harmless OU, SMBCE, YBCP & Associates from and against any liability or damages of any kind, and from any suits, claims or demands which are brought by these minor children, or on their behalf, including legal fees and expenses, whether or not in litigation, and which are in any way connected with the participation of these minor children in the Activity.
